Detained by Corruna PD in Shiawassee County
« on: July 04, 2011, 08:16:53 PM »
My wife, two daughters and I were at the city park in Corunna today enjoying the 4th of July festivities. We took a walk through the park passing by several officers without a word. We had stopped to watch some dogs running the obstacle course when I was  approached by about four city LEOs and four county LEOs. The city boy asked me for my ID and I told him that I did not need one to carry. He stated that indeed I did. I said that Michigan is not a "stop and ID state, but he persisted and asked if I had an ID. I said yes. “May I see it” he asked? I responded with a “no, Michigan is not a stop and ID state”. I then asked if I was being detained. He responded with a no. I asked if I was free to go and he said not until we figure this out and he said we will try this one more time, can I see your license?  Again I said no.  He said that i was not allowed to carry in the park. He said that the park was taken care of by the city. I said yes, with taxpayer dollars that makes it a city park. He then said that they have ordinances. I then stated that a city cannot make a law that supersedes state law. He then stated that I was now being detained. I asked on what basis I was being detained. and he would not answer me. I asked about three more times why I was being detained and he ignored me. The county Mounties were standing there and I told them that the city LEOs refused to tell me why I was being detained, they stated that they were not in control and that there is nothing they can do. Finally the Chief of Police (Williams) showed up and pulled me off to the side and said "I know why you are here" I said that I was here with my family. He said yeh, but I know why you are here, and again I stated that I was there with my wife and two daughters. He said that I was there with a gun because I could and I know that I can and that I am drawing attention to myself. I asked how and he made reference to my sidearm. I told him that if people’s eyes were drawn to it that that was no fault of mine. He again told me that I was attracting attention and told me I could go. They continued to follow us around until we left about 40 minutes later.
This whole situation took about 10 or 15 minutes.

Way to go nephew! Feels good doesn't it!
I told you williams was a real anti-dink. I'm surprised he didn't take your gun and run you through the mill. Then again, maybe after his experience with me at home depot; he may have learned his lesson about trying to enforce his opinion instead of the law.

Interesting.  Did you get it recorded? Though I'm not sure who you file a complaint with if part of the problem is the chief...

Christian Patriot, you are my hero! You had all the information you needed to stand your ground...and you stood it! Too bad for them that 8 to 1 odds wasn't enough intimidation. I'm smelling a nice hot dog picnic in Corunna. What do you think?

I'll make the drive & see if I can talk several of the Metro Detroit OCers near me to ride with me. Set it up!  8)

It sounds like someone needs to take a look at the ordinances in Corunna.

..... He said that i was not allowed to carry in the park. He said that the park was taken care of by the city. I said yes, with taxpayer dollars that makes it a city park. He then said that they have ordinances. I then stated that a city cannot make a law that supersedes state law. ......

Did we find out if there is an ordinance causing this issue?

I have not checked. The Chief acknowledged my right to carry. I'm guessing that the officer that detained me was running his mouth. I'm sure he didn't like me having an answer for every lie (or inaccuracy) that came out of his mouth! On my next day off I'll do a bit of digging. Can someone point me in the right direction to check on things like that. Thanx and thanx for y'alls support!

OHH!!! I already thanked my Uncle Jerry, but thank you all for all the info and videos and all that good stuff! It was those things that gave me the knowledge I needed to stand the constitutional ground that those in 1776 fought for!! Muchas gracias.

ARTICLE V.  OFFENSES AGAINST PUBLIC SAFETY (EXCERPT)
Sec. 50-137.  Carrying dangerous weapons.
(b)   Prohibitions.  It shall be unlawful to carry on any person or in the passenger compartment of any motor vehicle any dangerous weapon, including but not limited to, segments of chain, hunting knives, jackknifes having one or more blades which exceed three inches in length, clubs, paintball guns, metal pipes or any other dangerous weapon, unless carried in the normal course of business or profession, excluding firearms.

...excluding firearms... Hmm, seems like a recent afterthought. Maybe someone was pissed about that. There is one issue that appears to be an invalid ordinance in their code...

Chapter 26  CEMETERY (EXCERPT)
Sec. 26-18.  Rules and regulations.
(6)   Discharging of firearms, other than volleys at burial services, is prohibited, and on such occasion persons with firearms will not be admitted to the grounds, except as expressly authorized to participate in such type of service.

And the next scheduled city council meeting is July 18th at 7:00 pm.

I have never 'needed' my recorder yet in a over year of OC (I OC everywhere I go, and only had 2 friendly LEO contacts) but I never leave the house OC without it.  Think it was ~$30 then $20 for recharge-able batteries and charger.

Below is a copy of the letter that I sent to my local papers and so far, 1 has printed the story in today's paper (Argus Press) and it sounds as though the other will print in tomorrow's paper (The "Independent" only print twice per week). I was curious wether or not they would print it.

I openly carry a sidearm (second amendment to the constitution) on a
daily basis in accordance with State and Federal laws. I have been
doing so for over 7 months without an issue and much positive support,
untill July 4, 2011 that is.

My wife, two daughters and I were at McCurdy park in Corunna enjoying
the 4th of July festivities as we have for the last several years. We
took a walk through the park passing by several Law Enforcement
Officers (LEO’s) without a word. We had stopped to watch some dogs
running the obstacle course when I was  approached by about four
Corunna LEO’s and four County LEOs. One of the city LEO’s asked me for
my ID. I told him that I did not need one to carry. He stated that
indeed I did. I said that Michigan is not a "stop and ID state, but he
persisted and asked if I had an ID. I said yes. “May I see it” he
asked? I responded with a “no, Michigan is not a stop and ID state”.
I then asked if I was being detained. He responded with a no. I asked
if I was free to go. He said not until we figure this out. He
continued and said, we will try this one more time, can I see your
license?  Again I said no.  He said that i was not allowed to carry in
the park (Which is untrue). He said that the park was taken care of by
the city. I said yes, with taxpayer dollars that makes it a public
park and I can carry here. He then said that they have ordinances
(Also untrue). I then stated that a city cannot make a ordinance that
supersedes state law. He then stated that I was now being detained. I
asked on what basis I was being detained. and he would not answer me.
I asked about three more times why I was being detained and he ignored
me. At this point my constitutional rights are being violated! On the
4th of July none the less. Two County LEO’s were sitting there and I
told them that the city LEOs refused to tell me why I was being
detained, they stated that they were not in control and that there is
nothing they can do (untrue as well). Finally the Chief of Police
(Williams) showed up and pulled me off to the side and said "I know
why you are here" I said that I was here with my family. He said yeah,
but I know why you are here.
Again I stated that I was there with my wife and two daughters. He
said that I was there with a gun because I could and I know that I can
and that I am drawing attention to myself. I asked how? He made
reference to my sidearm. I told him that if people’s eyes were drawn
to it that that was no fault of mine. He again told me that I was
attracting attention and told me I was free to go. They continued to
follow us around until we left about 40 minutes later.

It is amazing to me how quickly these officers started spouting
untruths to get me to submit to their wishes. Not my family nor myself
were breaking any laws nor were we causing any issues. These officers
lied to me and illegally detained me while minding my own business and
being a law abiding citizen. There is a burden upon American Citizens
to know the laws and your constitutional rights! In this one situation
 I practiced my 1st, 2nd, and 4th amendment rights. A right not
 exercised is a right lost!
I could have been in a world of trouble had I not known my rights. Or
I could have gave up my (and your) rights and simply submitted to the
police. But if we choose to forego our rights, what is it to be an
 American citizen?
Furthermore, what the heck did our forefathers fight and give their
 lives for?

Good for you!  I hope perhaps this will generate some press and perhaps the LEOs in that area will be more careful in the future!  I wonder if the papers will recieve any response mail?
