Open carry in In. with Mi. CPL
« on: November 23, 2012, 10:50:11 PM »
I think I read somewhere that it was not legal to OC in In. with a Mi. CPL.
I believe the reasoning was that In. license is for license to carry a handgun, not specified concealed or open. Thus license is for residents and they have their choice to carry how they please. Our license is for concealed and does not give us a choice.

Open carry here in Mi. is legal for everyone with or without a CPL.

If you think my question is confusing try to find an answer to it.

Incorrect.  You can OC in IN with MI CPL.

Also, your statement that a MI CPL doesn't give us a choice whether to CC or OC is incorrect.  We still have a choice.

See below for additional info.

Here is the INDIANA code:

IC 35-47-2-21
Recognition of retail dealers' licenses and licenses to carry handguns issued by other states
Sec. 21. (a) Retail dealers' licenses issued by other states or foreign countries will not be recognized in Indiana except for sales at wholesale.
    (b) Licenses to carry handguns, issued by other states or foreign countries, will be recognized according to the terms thereof but only while the holders are not residents of Indiana.

What confuses people is (b) and IF you have a misunderstanding of MI law.  A MI CPL does NOT restrict a carrier to CC only.

The Mi. CPL does not give us the choice of open or concealed. It only gives us the right to conceal. We have the right to open carry because there is no law against open carry.
I'm sorry if I confused you with my question.

Your question didn't confuse me, and I am familiar with both IN and MI law. I also carry in IN frequently.

It only gives us the right to conceal.

Right?  You must mean "privilege" because a permit isn't needed to exercise a right.
