CATA Bus - Kicks off Pres of MOC
« on: April 13, 2013, 04:02:59 PM »

We're currently having constructive talks with them and their lawyer.  I've notified their lawyer that they've not yet implemented their new policy (which will allow OC on the bus) and they should do so quickly and property train their staff.

For reference, CATA's current Rules (which are invalid -- and they aren't even following those):

http://www.cata.org/RidingCATA/CATARules/tabid/69/Default.aspx

Quote
Weapons of any kind (unless concealed with a legal license) or possession of any hazardous material or item

1. I boarded the bus and paid my $1.25.
2. I sat down on an empty seat towards the back of the bus.
3. Looking around, I see the bus driver motions with his finger for me to come see him.
4. I approach him and he asks what I have on my hip, I tell him it's a handgun.
5. He tells me I have to get off the bus.
6. Video starts.

Prompt reply from their lawyer about the incident:

Quote
Mr.Hofmeister,

The dispatcher should have told the driver to let you on the bus.  The rule was not followed.
I will talk with CATA on Monday and get back with you.

At this point, what will be done about this?

I noticed in the video the dispatcher said "Federal Rule/Law".

I went to the Cata website as you linked and found they do have a clause for weapons.

For your safety and comfort, CATA does not permit these activities on any CATA vehicle or property including the CATA Transportation Center (CTC), shelters, and bus stops.

***Weapons of any kind (unless concealed with a legal license) or possession of any hazardous material or item

So it is on their website. Is this against the law with public transportation. Maybe a new rule or this rule has been eliminated but not updated? Does it have to be posted or properly worded on the bus itself or bus stop?

I commend you for standing your ground and getting it on video. I am learning so please excuse me.

See post 2. That's what's been done.

I'm told CATA will be training their staff very shortly (which we offered to review the training material) and a check for $1.25 is being dispatched to me.

Didnt you suffer frost bite on the way to your car? And get a parking ticket because the meter expired while you where walking to your car? Sounds like damages to me.

Meters aren't enforced on Saturdays. It was well above freezing that hour.

Well Phil, pat yourself on the back you made a difference. The initial problem has solved a potential problem for other law abiding citizens who wish to exercise their rights to open carry. Weather the initial problem should have happened in the first place is past discussion. Now we must keep the good fight going.

I'm still curious about the federal law thing. Was the dispatcher completely ignorant or given false info?

Like heck the meters are not enforced. Went to Buffalo wild wings after the rally and got a ticket. Put money in the meter and it only counted half the money I put in. I have the $20 ticket to prove it.
Common sense, isn't.
I can't fix stupid.

You must be mistaken, there is no BWW in Lansing.  There is a BWW in Delta township which has its own free parking and a BWW in East Lansing.  Parking Meters in downtown LANSING are not enforced on Saturday.

Letter of apology from the dispatcher and driver would have been icing on the cake :)

At least you got that refund. Thumbs up!

Unqualified Refund = admission of guilt by CATA -- that's good enough for me.
