Hello, I am brand new to this page so If I am posting in the wrong area please forgive me and if you could lend me a few pointers that would be nice.

My story begins little less than a month ago when I was walking late one night to the corner store about 100 yards away from my apartment to grab me a Soda and a bag of chips. I could not drive my truck because someone had side swiped my truck busting my side mirror.  I knew it would be a good idea to openly carry my holstered sidearm because of my cities violent reputation and the fact I would be alone and walking after dark.

As I was walking to the  corner store I noticed a police cruiser had pulled in front of me with its lights a'going and its spotlight on me.  Immediately I turned my hip to show the camera that the cruiser records that my sidearm was in fact  lawfully" Openly Carried " and not concealed. I raised my arms to show the officer that I was respectfully not going to grab for my sidearm. He approached me and I asked " Am I being detained officer? " and he simply did not answer and continued to approach me. He then removed my sidearm from its holster and removed the mag and lost a few rounds of my pretty expensive ammo " he didn't even say sorry " .

Knowing that I had nothing to hide, and that I was hiding nothing" as my sidearm was in fact openly carried for everyone to see" and that I had done absolutely nothing wrong I figured he would run my background and check my sidearm and release me happily to go home. Instead I was arrested and booked and spent  a few days  in the County Jail " lost track of time inside " over Christmas and released the next day. The arresting officer did not read me my Miranda Rights and only told me that I had the right to an attorney.


Basically the trauma I went through was a complete nightmare and to the point where I even debated selling my sidearm.
I have never been in trouble before.
I missed Christmas stuck in a cell knowing that I had done nothing wrong and there was nothing that I could do about it.
I feel like I done all that I could and handled it correctly but feel wronged.

I was hoping that someone could help me out or offer me some insight or maybe even share their own stories and what they had went through.

If your situation went down as you say it did, you may have a strong case, but that would be for an experienced lawyer to decide, which is why you need to seek one.

If your situation went down as you say it did, you may have a strong case, but that would be for an experienced lawyer to decide, which is why you need to seek one.

What happened at your arraignment?
How did you get out of jail?

Oh, in reference to your original question, you did "nothing" wrong. The so called "police" however did, again.

It would be nice if it were in fact, fake. I would hate to think this is still happening after all the promoting MOC has been doing with educating law enforcement and the public on the legality of open carry.

What arrest? They just locked him up for a month or so and let him out the next day. After Christmas of course.

I think this is important to all of us because this could happen to any of us and to stop or block this post would be an injustice to all of us.
We all need to know the outcome.

While I hope this is not one of our many LE trolls trying to entertain his pals at the donut getting place, it could be the case. This post is  creepy similar to what Detroit PD did to a OCer over another holiday weekend a couple of years ago. Right down to the pop & chips from corner gas station. In short - no one is immune to false arrest by a criminal wearing a badge. This said, ever notice how it's always the lone OCer who gets hassled? Maybe Johnny law is not such a bad@$$ when the odds are not clearly stacked in his favor? Protect yourself! Record all your OC. And if at all possible carry a smart phone that streams live to a web server! Why? It is amazing how often police video goes "missing".... :(
