You all may remember this thread where a local cop kept stealing Repeal SAFE Act signs.  Now a local physician has been caught doing it.  She's now been charged with theft.

UPDATE on SAFE ACT LAWSUIT

Many here may not know this, but last year a class action lawsuit was filed against the State of New York.  Under the Takings Clause of the United States Constitution, the state cannot deprive citizens of property without just compensation.   This lawsuit was brought on behalf of all citizens the Safe Act effects prior to January 15, 2014 compelling the state to pay fair value for all of the newly banned items. This will break the state and that is the attorney's exact intention.

It is estimated that the costs the state will have to bear may be as much as four billion dollars. The state wants to avoid this cost so that is why they are trying to convince gun owners to get rid of these banned items at no cost to the state. The state may be forced to capitulate.

Things are going well and yesterday an exciting, positive development occurred.  Unfortunately the attorney cannot disclose details at this time, but it is encouraging to know that things are progressing well.  I do keep up on this and will post periodically as things develop.

Because he's a cop of course.  They are above the law and can do no wrong of course.

I'm not sure theft would be the correct charge, but he did not have authority to remove the sign.  According to the local ordinances, which I looked up, only the housing/code official could do that, and only if they violated code, and only after a hearing, and only after the homeowner failed to remove the sign after the hearing found it in violation.

None of which ever happened.

The original homeowner has replaced the sign with a bigger one and after the national attention they got, the police have stopped stealing them.

It could have been theft and destruction of property though right?  Could you somehow consider it trespassing too since the cop came onto his property to commit a crime?

There was some issue on whether the land was right-of-way or not, so maybe not private property like next to the house.  Aside from that, though, the other violations exist.

Judge Tosses First SAFE Act Charge

A judge threw out the case against a gun-owner for having more than seven rounds in his gun's magazine.  The judge said the police conducted a search without a warrant.  IMO, the judge threw the case out because he found a reason to, on purpose.  Another judge could have easily agreed with the police.
