Disparity of force, no reasonable opportunity to retreat, I'd say putting them center mass on the leader until he ceased to be a threat would be a good shoot in just about any USA jurisdiction.

Too bad that in many places, a warning shot (hint for foolish Sunday School teachers: put it in the ground, not who-knows-where) is taken as evidence that you weren't in fear of immediate serious harm.

Remember, you didn't fire a warning shot, you just had very poor marksmanship.  ;)
