FOIA for 2013-2014 CCW Annual Report
« on: April 04, 2015, 01:37:25 PM »
So I submitted a FOIA request for the 2013-2014 CCW Annual Report to the MSP.

Quote from: MCL 28.425e(5)
The department of state police shall file with the secretary of the senate and the clerk of the house of representatives, and post on the department of state police's internet website, an annual report setting forth all of the following information for each county concealed weapon licensing board:
...

I received a notice of extension in the mail today. http://legislature.mi.gov/doc.aspx?mcl-15-235 Section 5 (2)(d) is relevant.  Interesting to need an extension for a report they are required to provide by statute.

So if MSP were law abiding, all they would have had to do in response to your FOID was give you a link to where it's already posted on their website?

No they haven't posted the 2013-2014 report, covering July 1, 2013 to June 31, 2014.

But that makes them law violators.
If they were law abiding, it WOULD be on their web site, right?

Sorry, didn't pick up on the sarcasm.

Just a follow-up.  The MSP denied my FOIA request because I was asking for compiled data, not a document.  WTF?!?  I requested a document containing compiled data that they are required to produce by statute.

New report is now available...

So they totally refused your FOID request but eventually made it available to all?
Was there a deadline for publication in the statute?

Yes, they denied my FOIA request and made it available to all.

There is no deadline in the current statute.
