Arrested for having a gun in his home while intoxicated
« on: August 02, 2010, 12:10:59 PM »
I saw this while going through the news at lunch today.  Any opinions on this?   I dont think anyone should handle a gun while intoxicated, but in his own home?  really?

What if you had your guns put away while drinking and then you heard someone breaking in?  Are you supposed to not defend yourself against someone who is threatening your life in your own house because you've been drinking?  I don't know about you all, but my life is just as important to me when I've been drinking as it is any other time.

If it were me I'd have my guns locked away but easily accessible (one of those quick access safes or something).

Didn't you know you are supposed to lock yourself in the gun safe, while carrying a firearm and drinking at home!

Stupid!

I agree.  While i dont think he needed to be handling the weapon, as a personal opinion - He's in his house....  HIS HOUSE!    i dont think anyone has the right to bust his balls for handling his weapon in HIS house.    Just bugs the hell out of me.

The way I see it there must be much more to this story!

This may have have something to do with it:

"DeRoche was sentenced to six months probation after pleading guilty in April to impaired driving."
"The claim and exercise of a constitutional right cannot be converted into a crime." Miller v. U.S. 230 F 486 at 489

"Where rights as secured by the Constitution are involved, there can be no rule making or legislation which will abrogate them." Miranda v. Ariz., 384 U.S. 436 at 491 (1966).

People stand up for your rights. Most people who cry about someone open carrying, can not get a gun and or cpl.
Folks will be folks. We will still do our thing. Carry On.
Open carry in Detroit
