I feared for my life
« on: November 06, 2015, 02:55:08 PM »
Police Officer Lisa Mearkle was just found not guilty on all three charges of third-degree murder, voluntary manslaughter, and involuntary manslaughter in the shooting death of David Kassick.  Mearkle had attempted to stop Kassick for an expired vehicle inspection sticker.  Kassick drove to his sister's house and then ran, possibly because he had been drinking.  No one really knows why.  Mearkle tased Kassick, then shot him twice in the back as he was laying on the ground.  Kassick was unarmed.

After viewing the following video the Dauphin County District Attorney filed murder charges against Mearkle.

We are always told that we cannot use deadly force unless we are in fear for our life.  Lisa Mearkle told the jury she was in fear for her life, and apparently the jury believed her.  Judge for yourself.

But...but...her extensive professional training tells her that her life is in grave danger whenever she cannot see a citizen's hands, and her life will end in a split second if he takes his hands out of his pockets when she orders him to...

In all seriousness, I can easily imagine 30-60% of jurors believing that he deserved it for running/resisting, or that it's wrong to send a cop to prison for doing her job, or even being afraid of police reprisal if they vote to convict, but a unanimous acquittal tells me that there was something seriously wrong with the case. My first guess is that the prosecutor didn't want a conviction, he just wanted to look like he tried to do his job.

In other news this week, a 2nd hung jury for the cop who put an Indian grandfather in the hospital for not understanding his (probably not lawful in the first place) commands.

I'd like to ask those jurors if they're OK with seeing their own father or grandfather laying in a hospital bed in a neck brace for the crime of lawfully minding his own lawful business because a LEO doesn't speak the same language he does.
