Springport man charged with murdering burglars
« on: October 04, 2016, 05:03:35 PM »
August: They were trespassing and  Jackson County Chief Assistant Prosecuting Attorney Kati Rezmierski said: "We received and reviewed the whole report of the incident this week, and I can assure the court there is no evidence they were breaking in."

October: Near the scene, police found a hatchet and pry-bar that belonged to the men. Also close by, officers found their pick-up truck, which had a third suspect hiding inside, along with what police say were stolen tools from a previous crime.

It looks like he did a public service, but probably wasn't defending his own life when he killed them. I'd be strongly inclined to give him a pass if I were on the jury.

Jury nullification is a taboo subject for the PTB.

Jury nullification is a taboo subject for the PTB.

Which PTB? MOC board? State government/judiciary? Federal government/judiciary?

I'm personally all for nullification of unjust (or unjustly applied) laws, but I doubt I'll ever make it onto a jury, since I give honest answers during voir dire.

Good point. If this guy were in Eaton County, I wouldn't be on his jury.

I was hoping that was what you meant. I didn't think that the BOD had ever expressed an opinion on the topic, and I highly doubt any of the BOD members I've met would have a personal problem with nullification. I just wanted to be sure there wasn't some sort of misunderstanding.
