Open carry question
« on: May 08, 2012, 12:44:07 PM »
I have a CPL.  If I am asked for ID by a LEO while I am open carrying, am I required to provide my ID?

To my knowledge, the only obligation to present ID is described in 28.425f.
Quote
(2) An individual who is licensed under this act to carry a concealed pistol and who is carrying a concealed pistol shall show both of the following to a peace officer upon request by that peace officer:
  (a) His or her license to carry a concealed pistol.
  (b) His or her driver license or Michigan personal identification card.

Unless there is some reason you would need to ID regardless of CPL, you only need to present ID if you are carrying a concealed pistol.

Agreed... use wash, rinse, repeat...    first thing out of your mouth should be "am I being detained?"  If no, "Have a nice day" and walk away.  If yes, and only OCing, you still may not have to ID as michigan is not a stop and ID state.  If yes and CCing while OCing, then you have to disclose and show CPL.

If you are detained, you must disclose. Waiting for them to request will ruin your whole day.

Best practice is to disclose for any interaction beyond 'Nice weather we're having'
Its not GUN rights, its HUMAN rights.
