School holiday show
« on: December 11, 2013, 03:33:47 PM »
Tomorrow the 12th is my boys' holiday program being held at a local church. I want to OC, I guess I am a little hesitant since it is a school function. Any advice on this would be appreciated. I do have my cpl. Thanks fellas.

By law, and recent MCOA ruling, the school cannot regulate firearms to an extent stricter than state and or federal law.

If you have a CPL and you OC, there are no laws saying that you may not do this on church or school grounds. IANAL, but as far as I can tell, the only thing you would need to worry about is the church (private property) asking you to leave. Should you decline, you may face a trespassing charge.

As for advice:

- Remain calm, polite, and respectful.
- Carry a recorder and have it on and working.
- Know and understand wash - rinse - repeat.

Here is a list of materials that I bring with me whenever I OC into a school. I keep them in a folder that I grab. Keep in mind, a church is still private property and has exclusive rights to determine who they permit on their property.
(Updated) List of "materials" I brought with me:
- GRPS Superintendent statement (see the end of the article) [March 2012] http://www.woodtv.com/dpp/news/local/kent_county/No-charges-over-gun-in-voting-booth
- Birmingham Public Schools outside legal counsel Clark Hill PLC "Right to Open Carry Firearms Cannot be Restricted" [November 2012] http://www.clarkhill.com/Modules/Document/documents11/Education%20Law%20Update%2011.2.12.mht
- CADL vs. MOC Court of Appeals rulling (See Pg 6 & 11)  [October 2012] http://publicdocs.courts.mi.gov:81/OPINIONS/FINAL/COA/20121025_C304582_65_304582.OPN.PDF
- MSP Legal Update 86 [October 2010] http://www.michigan.gov/documents/msp/MSP_Legal_Update_No._86_2_336854_7.pdf
- MCL 28.425o No CC zones law http://www.legislature.mi.gov/%28S%28cu3ztercp0ufpxbuo0w2x5ic%29%29/mileg.aspx?page=GetObject&objectname=mcl-28-425o
- Contact info for a lawyer or two

Lastly, smile. Seriously.

Have you ever met the pastor/priest, does he know your views on guns?

Have not met pastor, this is a place to hold the program because school is not big enough.  I will read the links you sent (after I take boys sledding at Charlie's dump).

I do carry a miniaturized version of the msp 86 update in my wallet. I will update my experience after the program in OC EXPERIENCES. THANKS For the advice and confidence.

I tell ya this community is great. I have learned a lot in the past couple months. Stay tuned.

Know and understand wash - rinse - repeat

Not sure what this means in this circumstance. Help

What to do when being confronted by an officer. Every situation is different and it is up to you to determine the best course of action. The standard recommendation from MOC is as follows:

If you are stopped by an officer, ask "Am I being detained?". I like this as opposed to "Am I free to go?", because a non answer gives you more leeway and forces their hand.
If no or no answer, politely walk away. If yes, ask "Why am I being detained?"
The answer will most likely be something about because you have a gun. Respond by saying "That is not illegal".
Jump back to step 1. Repeat. Repeat. Repeat. (Nicknamed Wash, Rinse, Repeat).

Do not tell them anything else, and do not editorialize on the law as the wording of the law does not matter at this point. A good officer will understand, and an officer that is fishing for something to catch you on, you won't want to talk to anyways.

You are not looking for confrontation. In fact, it's the exact opposite.

1. Is the school public or private? Private schools definitely are NOT preempted.
2. Regardless, the church is private property and NOT preempted.

Public school. Correct you are about both.

I keep forgetting to stop assuming the school is public. Thanks Q.
