Probable cause?
« on: December 04, 2010, 12:59:23 PM »
Everyone is welcome to comment but current and past LEOs would be appreciated. I attend a college I have tried time and time again to get information on what is legal (talking knife and multitool with knife in it). Lets say I wear my MOC shirt and the rent-a-cops (sorry but so far the ones that I have seen and meet are definately not the sharpest tool in the shed) see it do they have probable cause to search me?

Hmmm the almighty PC. Probable cause is more of a color of law for the individual officer. One officer may see he has probable cause and another may not. As for what you can carry. I would guess no weapons means non what so ever IE knife, mace, baton, firearm, grenade, laws rocket or tow missile. However your school should have issued you a code of conduct which should include all items the school considers "A weapon" For instance a box cutter may not be in the print, nor a straight razor. Wearing a shirt is not probable cause even if the shirt were to say "I HAVE A BOMB!" Do to the Fact that on the back of the shirt it may say "Dont walk behind me"

No a shirt doesn't constitute Reasonable Articulate Suspicion.  Can the rent a cop question you? sure! it all depends on how far you are willing to defend the 4th Amendments. Try this some time...Sir at this time I exercise my 4th Amendment rights.  No warrant no searchy!
